It is entirely legitimate to criticize a defieicency of prosecution of corporate crime. While our statute make The decision by the DOJ not to emphasize criminal investigations or prosecutions of either the loan companies that caused the nation's latest economic collapse, Or to pursue cases against corporations responsible for environmental calamities ( Think the BP devastation), Is at heart political. mister. Here's a matter: Under the RICO act you can prosecute a member of a criminal financial institution for crimes that were performed by their soldiers. How is this fact, in the least, more advanced than a crime committed by a member of a corporation? If a safety officer that you pay purposefully breaks the law (And may did so at the behest of his superiors) Should the management of that organization not also be held responsible, If the RICO act is valid,/p>
This double standard is a complete slap in the face of persons everywhere. Why is that fictitious entities can do whatever they damn please and inflict human suffering without consequence while ordinary people are jailed and punished without mercy,/p>
I don't realize how an officer of the court, Sworn to uphold and enforce the laws of the us can possibly have the power to prosecute some criminals and not others. How can he have the power to make that decision? which should be out of any individuals hands. If a crime has been found to have been committed then there shouldn't be other recourse but to prosecute the person s responsible. If the decision has been made not to prosecute then the prosecuter should be subject to an investigation and if he has been found to be in deriliction of his duties then he should be charged. These really should not optional actions. If some are free to ignore the law than every individual has a right and a duty to ignore the law. If it is every man for himself then this is the law. No law is the law also,/p>
I think main reason for focusing on intentional crimes vs industrial accident due to criminal negligence is that many people don't understand that there is really NO such thing as industrial "lock up, When engineering system is designed the team identifies disadvantages of the structure reinforces them calculates potential scenarios of accumulated damage (reduced damage) construction and includes that data in specs. So if we know that under typical working condition fracture in a part goes from detectable size to devastating failure in say 2 years then that part has to be inspected every year. there is no randomness or "hand of God, It is well know engineering not a nuclear physics. So if factory ignores such inspection procedure and run factory for 28 years without major inspection they play Russian roulette with lives of all people living in same city. And that is nothing but murder. but then again what do you expect from our corporate press old factory failure brings much less ad revenue than juicy story of two Chechen brothers,/p>
